Since we are still married and I have sole physical custody can he really stop me from going on vacation with my son?

Robert Jensen 'Bob' Matlock

Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
If there are orders in effect, you need to abide by the orders. There may be Standing Orders that took effect when the divorce was filed and, if so, those orders may say that no one is to take the child beyond the jurisdiction of the court. I suggest you hire a lawyer.

What should I do to ensure that my ex-husband will pay me for the house?

Answered by attorney Anthony James Sturniolo (Unclaimed Profile)
Divorce lawyer at Sturniolo & Associates
You have a couple options to enforce the Permanent Orders. You can obtain a Judgment against him for that amount plus interest and garnish his bank accounts and wages. The second option is a contempt citation against him for non payment. You can request attorney fees on both options. Your question does not indicate if the 5 years has passed yet.

Can I move out of state with my child during a divorce with soon-to-be ex-husband's consent (notarized)?

Answered by attorney John E. Kirchner (Unclaimed Profile)

Legally, yes. To protect against future allegations, the written consent should be filed in the court file. Due to Colorado's strict requirements that either you or your husband be a legal, domiciliary resident of Colorado for at least 90 days before filing the petition and the complexities of trying to handle your case from CA without an attorney, you should consult a CO attorney and not try to continue the case without an attorney.
