How long does a divorce case usually take?

default-avatar
Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
If both parties are cooperative and in agreement, a divorce can typically be finalized in 2-3 months in Florida. However, if one party isn't cooperative or if both parties are not in agreement on everything, it can take a year or more. You should consult with an attorney who can best guide you through the process.

If you are paying child support, does it mean you are completely divorced or still be legally married and separated while paying?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
Divorce lawyer at Catchick Law, P.C.
Just because you are paying child support does NOT necessarily mean you are legally divorced. In Michigan, you are not legally divorced until the Judge SIGNS a document known as the "Judgment of Divorce."

How do I get rid of her without losing a bunch of money or assets?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
1. Find an experienced family lawyer in your area. 2. Tell him or her all the details behind what you have put in your question. 3. Do not be scared of what your wife says. If you live in a marital/community property state, such as Wisconsin, the court will not award her much because of the short marriage. It might well be similar in other such states. Even in other states, many of them have legislated 'equitable' division of property. In this case such laws would also protect you. But mainly, see a skilled lawyer and don't believe what your wife says.
