I''m in NY doing my own divorce and filing out Affirmation of Regularity and I''m having trouble with a question? Number 7 on the form to be exact.

Answered by attorney Alfred Joseph Polizzotto
Divorce lawyer at Polizzotto & Polizzotto, LLC
If your spouse has executed the Affidavit of Defendant in an uncontested divorce, then the correct choice would normally be that the Defendant appeared and executed an affidavit agreeing that the matter be placed in the matrimonial calendar immediately.   This language is normally recited within the affidavit that your spouse executed.  WIthout examining the package you are submitting, it is difficult to ascertain that the forms are all correctly prepared and executed.  You should consult with an attorney in matrimonial law to ensure that all of your rights have been protected and that you have not overlooked any provisions of law which might otherwise prove to be to your advantage. - Alfred Polizzotto, III

What would i be entitled too?

It's not possible to answer your question fully based upon the information you posted. You should arrange a consultation with a local attorney, and be prepared to discuss who works where, how much money each of you makes, and who would have residential custody of your daughter.

When selling a house for a divorce, if a down payment was made, does the person get it back before house is split up?

Morghan Leia Richardson
Answered by attorney Morghan Leia Richardson (Unclaimed Profile)

The answer really depends on the down payment: was a gift to you and your husband, or just a gift to your husband? Generally, any equity put down from one person will be credited back first before the remaining equity is divided. It sounds like your MIL put down some money and lives in the house, making payments, and she may be an owner of the house with you and your husband, in which case she would get her money and equity back. Talk to a lawyer in person to get a more detailed answer because property issues are very fact specific. Good luck!
