If I am paying alimony and my ex remarries, do I have to file with the court to stop payment or is it automatic?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)

Nothing is automatic, so if your judgment says support ends on remarriage (typically it does), then immediately file to stop it and request retroactivity to the date of filing. If in doubt have an attorney review your judgment documents. Opinion only, not legal advice.

What do I need to do if my spouse and I have been separated for five years and I want to get a divorce?

Answered by attorney Brook Andrew Goddard (Unclaimed Profile)

A divorce in Washington state is initiated by the filing of a Petition for Dissolution of Marriage. As part of your dissolution proceedings, you will present requests to the court for a parenting plan that addresses the father's lack of involvement, and will also get a child support order so that he supports his children (even if he chooses not to see them).

Does my wife have any rights to monetary gifts given to me prior to us getting divorced?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)

Money or property earned or given to you as a gift after the separation are separate property. Separation is living separate with the intention to get divorced so the sooner the better to avoid future confusion.
