How do I get divorce and retain my green card?

Answered by attorney David Nabow Soloway
Divorce lawyer at Kennedy, Nalepa & Soloway, P.C.
I am sorry to learn that you have been the victim of domestic violence and torture, and to learn of the problems with your marriage that you described. There is no way that a U.S. citizen spouse can terminate his foreign national's Permanent Resident status (her "Green Card"), since that is a benefit issued by the U.S. government and not by the U.S. citizen spouse. Although not completely clear from your question, it sounds like you traveled outside the U.S. two months ago and are staying in your parents' house. Be aware that a single absence from the U.S. of 180 days or more may trigger a presumption that you have abandoned your residence in the U.S. (and your Permanent Resident status), and a single absence of a year or more may trigger a non-rebuttable determination of abandonment. It would be wise for you to consult with a domestic relations (divorce) attorney about your rights and responsibilities in the event of a divorce, and if that attorney does not have sufficient expertise relating to the immigration issues, that attorney should communicate with or associate an immigration attorney.

What can I get as a common law wife?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
It depends upon what state you are in and their laws, in Michigan they are no property rights arising out of a meretricious relationship. In other states, after period of time, and holding yourself out as husband and wife they consider married.

Should a disabled person give full support to the wife?

Answered by attorney Robert E McCall (Unclaimed Profile)
Divorce lawyer at Law Office of Robert E. McCall
Disabled person needs to speak with attorney ASAP. Wife cannot steal, if she was the Payee Rep for disability purposes she is a fiduciary and has extra responsibilities. Her actions may be criminal.
