Can I go ahead and put my house up for sale if the mortgage is in my name only but the deed also has my spouse's name on it?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
If the deed is in both names, you will need to have both people consent to the sale.  Many realtors will require both people to sign the listing agreement.  even though your ex is not on the mortgage, his/her name is on the deed and he/she will need to sign the deed to complete the sale.

Promised $1200/mo pension in 1999 settlement papers is $785/mo in 2016. Is ex-husband liable for the rest of the $415?

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
It may be appropriate to request your ex-spouse pay the difference between $1,200 and $785 per month, particularly based on the terms of your Settlement Agreement and under the unique circumstances of your case. If your ex-spouse is unwilling to do so voluntarily, you may need to file a motion to ask the court to order your ex-spouse to pay the $415 per month. The attorneys at Weinberger Law Group offer a free initial consultation.  I urge you to call today and schedule an appointment with one of our attorneys.  Bring with you to your appointment a copy of your Settlement Agreement, Judgment of Divorce and any documents you have regarding your ex-spouse's pension.  The attorneys at Weinberger Law Group are happy to consult with you and discuss this matter with you in more detail as well as to strategize with you about your next steps.  Call (855) 548-2157 today to schedule your appointment.

Why does it cost so much to get a divorce in New Jersey? I have paid my attorney off this year in full. I paid a retainer and paid as proceedings progressed and still owed at the end. We settled out of court and it cost close to $30,000 for a divorce and our civil ceremony only cost $28.

Answered by attorney Diana L. Anderson

Why is it expensive?  Because attorneys had to get involved.  If you had been able to decide on your own how to get divorced, in the same manner that you decided on your own to get married, then the cost would not have been so high.  That's why mediation and collaborative divorce can be so much less expensive.
