In order to answer the question I would need to look at the decree of dissolution of marriage and know what the ex-wife is earning. In order to modify spousal maintenance there needs to be an on going and continuing change of circumstances. The court will look at if the parties are sharing expenses with another person to determine if the person paying has the ability to pay the spousal maintenance. I would consult with an attorney because spousal maintenance is very complicated.

Get an order that he has to make 10 face to face job contacts per week and report them to your attorney and the court. Get review date and an order for a vocational evaluation so the court can impute income to him.
