Do I still have to get a divorce if my wife and I have already been separated for 4 and a half years?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
You are legally married until you file for divorce and a court enters a final judgment. Your status cannot be changed from married to single less than six months and 1 day from the date the court has jurisdiction over the parties. If you both are in agreement on all issues you can file an uncontested divorce.

Can I write a document stating my wife is asking me to leave marital residence so it’s not abandonment?

Answered by attorney J. Allen Fiorletta
Divorce lawyer at The Fiorletta Law Group, PLLC
Spouses move out of the marital home quite frequently during a divorce. It will not be considered abandonment and you do not need a note from your spouse.

Is there any way I can get a divorce court order withdrawn or changed?

Answered by attorney Patricia A. Kasody-Coyle
Divorce lawyer at Jackman & Kasody, PLLC
The only way to change the terms of your JOD regarding what you owe your ex is if your ex is willing to consent to a modification of those terms, otherwise you owe the money and he could file a motion to enforce the judgment. This response is general in nature and is not legal advice.  No attorney client relationship is formed by it.
