How could I serve my husband with divorce paperwork if he lives outside of the country?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)

To answer your question, no, email correspondence does not suffice as legal service in the state of Texas. You're going to need to attempt to get an address from him (either his residence or employment) and send registered mail through the clerk's office of the county where you file for divorce. Because your husband is out of the country, I strongly recommend hiring a local attorney to help you. You will need the court's approval to have your husband served by other means, and an appropriate motion must be filed.

If I pay alimony and lose my job do I still have to pay?

John W. Havins
Answered by attorney John W. Havins (Unclaimed Profile)
Divorce lawyer at Havins & Associates, PC
It depends on whether your Judgment of Divorce says that alimony is modifiable or non-modifiable.  Even if non-modifiable, if a change of circumstances creates an impossibility to pay alimony, then the court may be able to give you some relief.  Another option is if you and your ex-wife agree to a change then a Stipulation and Order can enter with that change.
