FOR WEST VIRGINIA ONLY: If a spouse does not appear in a divorce action and agree to a divorce on the grounds of irreconcilable differences, then one of the parties can still obtain a divorce on the grounds of having been separated for more than one year (for over 12 months), without living together and cohabitating as husband and wife.

If the record can be authenticated, it is admissible in any court proceeding. I have seen text messages used many, many times.

Can a paralegal handle a contested divorce? It is a contested divorce because my husband has not finished the uncontested divorce.

A paralegal does not have a license to practice law and cannot give legal advice, they can only fill out forms that have been approved by the Supreme Court, basically, and simply cannot represent people in court. So, no, a paralegal cannot handle a contested divorce.
