Can I file for a separation and still live with spouse in NY?

In New York State you cannot file for separation, but only for divorce.  A separation is usually only done between both parties by a separation agreement, which involves both you and your husband agreeing to all of the terms of the separation.  If you filed for divorce, then you could ask the court to grant you exclusive possession of the marital residence, i.e. your apartment, while the case is pending.  But without a divorce being filed, there is no real mechanism to file for just separation and have your husband leave the apartment without his agreement.
