Where should I file?

David M. Rich
Answered by attorney David M. Rich (Unclaimed Profile)
Divorce lawyer at Flatiron Legal Advisors LLC
You can file in the county where you live. If you file jointly as petitioner and co-petitioner, you don't need a waiver of service. If there are no children, you should be able to get though it without any court appearances, but there are some deadlines you have to meet to avoid going to court. I hope this helps.

Is our marriage void if my wife was married at the time?

Answered by attorney Michael V. Fancher (Unclaimed Profile)
Divorce lawyer at Seattle Divorce Services
Your marriage is at least potential invalid if your wife was married at the time. I do not know of a way to fix the marriage certificate. It may be possible to remarry. I would suggest consulting with any attorney in your area for more specific information on this issue.

How do I claim my portion of my ex husbands retirement?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Divorce lawyer at Hernandez & Suarez, PL
To be able to obtain entitlement to the retirement of your, what seems now ex-husband, you must draft and submit to the retirement company a QDRO, Qualified Domestic Relations Order. This is an Order that a lay person is not recommended to prepare, in fact, many attorneys do not draft these orders. But, one must be prepared and submitted to the retirement company so when you become entitled to the funds, when your husband or ex-husband retires, you can receive your share.
