Can I keep my child from seeing my husbands new girlfriend until our divorce is final?

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
You can make such a request, but it depends on the court whether it will be granted. The standard request is a morality clause that says no overnight paramours when the children are there. That clause can be effective beyond the divorce. You can use his affair to ask for a disproportionate share of property division.

It depends on the language of the final judgment. Have your attorney review the document. If no attorney ask the bank personnel who is handling the refinance for opinion.

In Texas, you will have a very hard time finding a judge who will sign off on a divorce while the wife is still pregnant, but the wife is not permitted to refuse DNA testing of the child.
