Your ex husbands lawyer may not be responsible for preparing the QDRO. Normally lawyers use a CPA or other professional to prepare the QDRO order.  You should find out who was supposed to prepare the QDRO? A QDRO costs about $750 and is normally prepared after the final judgment of dissolution.  Your husband may not be aware of his responsibility to get the QDRO prepared. His lawyer may or may not be paid to prepare the QDRO and your husband may not be aware that he has to hire an outside CPA or other professional to prepare it.  One option might be to file a "motion to enforce final judgment and/or motion for contempt and have your ex explain to a judge why he has not complied with the final judgment.

You probably can sue for emotional distress, but it will cost you a ton of money for nothing. The better thing to do might be to file a petition for protection from domestic violence. If and when you do, do not ramble on, just state the facts of the physical abuse.
