If one party gets a vehicle in the divorce, can the other party be held responsible by a creditor for it?

A divorce only resolves property issues between the two parties (husband and wife). A divorce court has no authority to involve third party creditors or affect their rights. If your wife co-signed the auto loan with her ex, then she promised to be responsible for the debt if he was not. Even though the judgment of divorce might say the ex is responsible for the debt on the truck, that is only between the ex and your girlfriend. The creditor has every right to collect from your girlfriend if the ex does not pay. Her only legal remedy is to haul the ex back into court for contempt for failure to follow the judgment, assuming the judgment states that he is responsible for that debt.

You need to "show cause" your ex-wife in the Divorce Court, to enforce the terms of the Judgment of Divorce. Also, request sanctions and attorney fees against her. Talk to a CPA about raising the issue with the IRS - I believe there may be an IRS form you can file when the issue of who gets to claim the dependency exemption is in dispute between divorced Parties.

First of all, change the locks on the doors! If you are renting, get the landlord's permission first. Second, is her name on the lease, or just yours? If hers is on the lease you need to send a certified letter to the landlord stating that she has abandoned the leased property and you are now the sole occupant and any security deposit he holds is now yours. Thirdly, Who bought the furniture? Do you have receipts? She would have to take you to small claims court and prove her ownership of the furnishing in order to remove them from the home. Fourth, file a small claims action against her for her share of the bills, which as a former roommate she is liable for.
