Legally, his money is yours and yours is his. You don't say whether you're separated, but I suspect you are. If so the only way you're going to force him to share his retirement benefit is to sue and get a court order.

If you married her formally and you've never gotten divorced from her, you're still married to her. However, if you were never formally married with a marriage license and a judge or minister, the right to claim common law marriage expired two years after you split up.

If he was legally married to someone else at the time he married you, you can seek to void the marriage through a Nullity action. Since you are the innocent party here (assuming you we're unaware of his marriage status), you are considered a "Putative" spouse and can seek support and a property division from him.
