Getting a military divorce

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
If you have lived in Florida for the past 6 months then either of you can file for divorce.  State law governs your divorce even if either or both of you are in the military.    In Florida the only grounds one must assert for filing divorce is that the parties have "irreconcilable differences."  Although it is unfortunate if there was abuse in your marriage it is not a ground for divorce.  As an aside, if there is physical abuse you may want to file for a domestic violence injunction.  The clerk of the court in the county where you reside can assist you in filing out and filing these papers.    As to alimony, typically someone in a one year marriage would not receive alimony, although there may be circumstances in your relationship that would allow same.  Florida law does provide for bridge-the-gap alimony to assist a spouse in making a financial transition from married life to single life, so that may be a posibility for you. Best of luck, Cindy S. Vova Law Office of Cindy S. Vova, P.A. 8551 West Sunrise Blvd., Suite 301 Plantation, FL 33322 info@vovalaw.com 954.316.3496

If you have been seperated for over 10 yrs do you have to pay your spouse a certain amount and why?

She can ask for the sun, the moon and the stars, but the Court does not have to give it to her. In Wisconsin, maintenance has two distinct goals: to help the lower-earning spouse 'rehabilitate' her- or himself in the employment market, and to maintain the spouse as close as possible to the standard of living the spouse enjoyed before the divorce. If you have been separated for 10 years, it is highly unlikely that her standard of living over mot of those ten years depended on your contributions to her living expenses. She is not likely to prevail on a demand for maintenance. She might, just possibly, get some short-term award of maintenance, but I wouldn't think that is very likely. You should really retain a skilled family law attorney to advise and represent you. It's almost always worth it. Good Luck.

Can I get a divorce if we got married on 05-06-2011 and we stayed together for 3 month and I moved back to my place and husband agrees?

If you live in Colorado the only requirement to obtain a divorce is that the marriage is irretrievably broken - there is no time limit for length of marriage or separation. If you are in another state you need to consult an attorney in that state to find out the requirements for divorce.
