It is hard to say what you are entitled to as it is not just the length of the marriage that is a factor in asset distribution. As for marital rape, you would need to give your attorney all the facts that would make this a part of the divorce action. Also any other allegations of abuse you might have against your husband.

First, the obvious: threats are both easy to make and foolish. Under the facts you describe the business and its assets are marital property. The appropriate way to handle this is to file for divorce quickly so that anything he does to damage the business is charged against his side in the equitable distribution. You should retain a local divorce lawyer and get to work - filing, by the way, is in Supreme, not Family Court.
