If the stock is kept separate and not mixed with other assets, and your name is not added then it is technically a non marital asset.  IF your husband has paid in money or contributed other assets to the business, then you may have a claim. However a gift that is kept separate is normally not considered marital

You can file for dissolution of your marriage whether or not you know where your Husband is. Once you have filed, you go about serving him in the case. You will perform a diligent search and inquiry trying to find out his whereabouts. There is a form for it on the Florida Supreme Court's website. If you can locate him, you can undertake to serve him. If you cannot locate him, you will get a notice of action from the clerk. It can be published in the paper or posted at the Courthouse. A month later you can go in front of the Court for your divorce.
