How long will it usually take to receive a court date for a divorce after my husband has been served? We live in Texas and have one 2yr old daughter

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
If you requested a TRO, you should have gotten a court date. If you did not request a TRO, you can request a temporary orders hearing and the court coordinator will provide a date for the hearing. If you're asking about a final trial date, again, you woule work with the court coorinator to get a final trial date. Each county and court is different, so you must work with the court coordinator for the court where your case is assigned to get a schedule for your case.

Husband wont sign waiver of service because divorce decree he thinks i am asking for car, thought it was stating what was our property together

Kimberly Demetrice French

If your husband won't sign the waiver of service, you will need to have him served at his work address or home address if you two are separated. You will need to request a citation from the court and you can send the petition via certified mail or a process server can personally deliver it for a fee.

Is my spouse entitle to any of the retirement plan?

default-avatar
Answered by attorney John George Galasso (Unclaimed Profile)
Divorce lawyer at Law Office of John G. Galasso
In Ohio, we are an equitable distribution state; Your spouse is entitled to one-half of your retirement earned during the course of the marriage; In order to determine what that amount would be, you would have the get what is called a Qualified Domestic Order (QDR) done; Sometimes the retirement plan will provide the necessary documents and compute the value for a fixed fee, otherwise you either have to have a lawyer do it or find a company that specializes in them
