If you are in Colorado, the limited facts you have provided suggest that the home is marital property, but that is a question that requires much more information and analysis before it would possible to predict how a judge might rule if you and your wife can't agree. The marital property label is only relevant as to the equity value of the property and there is no way to say what should or will happen if you and she cannot agree. The key point is that the name on the deed does not drive the train as to what should be done.

A divorce is a lawsuit and begins when the person seeking a divorce files a Complaint for Divorce.  ONce your file the lawsuit, then you must serve your husband with the lawsuit.  If you do not know where your husband is, then you can seek permission from the court for an alternative method to serve him with the lawsuit such as publishing notice in the newspaper.  If he fails to respond, then the Court may enter the divorce and determine the issues of custody, parenting time, child support, alimony, and property division even in his absence.  Children born during a marriage are deemed to be the children of the married couple.  If your husband appears for the divorce, he can argue that a child is not his base upon his absence.  If you want the true father to be the legal father, you can address that issue with the court.  Stu Shafer

That depends. Virtually no U.S.A. attorney can assist your son to get a divorce in S.K. But, if he wishes to get a divorce in Cal. he can be assisted preferably by an attorney in the County in which he is a resident. You provide virtually no information. Why doesn't he handle his own inquiry? I have represented a service member stationed in S.K. and we had excellent communication.
