What happens to the land contract when the person purchased hid home owner dies

Answered by attorney Gilbert Borman
Divorce lawyer at Borman-Lahti PLLC
If the land contract was done during the marriage, she might have a marital claim unless it was not a listed asset of the marital estate if the land contract began after he died, the former spouse has no claim and the heirs of the deceased have full rights to the property   if the ex invested in the land contract after the divorce, then she will need a writing to make any claim

How can I divorce my husband if I have no idea about his whereabouts?

Answered by attorney Marco Caviglia (Unclaimed Profile)
Divorce lawyer at Marco Caviglia, Esq.
Your husband must be served personally with the summons for divorce. Typically, this type of situation is solved by hiring a skip tracer to locate him and then having a process server serve him there personally. If after a due diligence search is made and still no luck, if the court agrees, then it can issue alternative service methods.

What happens to the protection order if both parties have an ex parte restraining order and one violates the ex parte and can it be dismissed?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Divorce lawyer at Cathy R. Cook, Attorney at Law
Your question is a bit confusing. Each order is separate. Each violation can be both prosecuted as a crime and found to be a contempt. If the person who brought the protection order doesn't want to continue it, it can be terminated. However, criminal prosecution of the violation is up to the state.
