Since they are married, your daughter should get a temporary order with a move-out date for the husband. In eviction court, he could just say he's her husband and the judge won't have jurisdiction to evict him. This is a family law matter that should be handled in family court.

You need to file for divorce and get an order compelling him to give you your things. Also, it sounds like the house may be transmuted into community property or, at worst, that some portion of the principle may be yours. You should talk with a local attorney about this.
