If you have ever lived in the state of Texas for six months and once you reside in a county of Texas for ninety days then you can file for divorce in Texas in the county of your residence. You may seek temporary orders for support, use of the property, payment of the bills, child custody, visitation and child support along with restraining orders or injunctions. Upon divorce the court will make orders that are in the best interest of the children and divide the community assets and debts in a just and fair manner considering fault in the breakup.
If you have ever lived in the state of Texas for six months and once you reside in a county of Texas for ninety days then you can file for divorce in Texas in the county of your residence. There is no such thing as legal separation in the state of Texas. I strongly recommend you schedule a consultation with a family attorney in the State of Texas to determine whether or not your wife actually got a divorce or under what circumstances a judge ordered you to pay child support if you two are still married. If you're only separated (not legally divorced), then yes your wife would need to sign the paperwork for you to purchase a home, so it is imperative that you get divorced as soon as you can to make sure you are the only one legally benefiting from this transaction.

If there are no minor children, either party can file for a divorce in a state where they meet the residency requirements, or they can file in the state where the spouse meets residency requirements. If you cannot agree on where the divorce should be filed, the court would consider whether either spouse has lived in the other state during the marriage, or where the acts giving rise to the divorce took place.
