Is there a law or rule in NJ that no one is allowed to sell marital property or use marital assets during the divorce?

Richard Scott Diamond
Answered by attorney Richard Scott Diamond (Unclaimed Profile)
Divorce lawyer at Diamond & Diamond, P.A.
If you are going through a divorce and your spouse is / has sold off assets of the marriage without your consent, you need to consider filing an application with the court for sanctions against him / her. As part of your application, if you beleive that he did so, to try and prevent you from sharing in it or with the plan to re-acquire it at a later date, you need to present all of your proofs now so that a judge can address it and potentially hold your spouse accountable for its value, etc in the divorce or to compel its return.

How do I nicely tell my attorney that he is billing me for ridiculous things in a way that he will cancel the charges?

default-avatar
Answered by attorney John F. Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
I would suggest you consider the attorney's situation, twice you interrupted his chain of thought and therefore took his time. Many attorneys' charge .25 to .3 minimum per communication are that is what an interruption actually costs them in time. I would ask he reconsidered the billing and thereafter you be more judicious about your contacting him. If you wish to take his time and seek his opinion then you must also be prepared to pay for it, it is what he does for a living - and I am sure you do not work for free.

My husband and his attorney are refusing to participate in a settlement conference, is trial the only option left?

default-avatar
Answered by attorney Stuart Jon Bierman (Unclaimed Profile)
Divorce lawyer at The Law Offices of Stuart Jon Bierman
Generally, a party in a divorce case is strongly encouraged by the Judge to engage in good faith settlement negotiations. The Judges have ways to motivate people to participate in settlement conferences but they cannot actually force someone to negotiate in good faith. I think your instincts are good about him being unreasonable and it could very well be that your husband has decided to refuse to negotiate with you because he thinks that he can steamroll you when the case goes to trial since you do not have an attorney.
