Yes if he has been defaulted he has to file a motion to overturn the default pursuant to the court rules..However in many family courts the court rules are relaxed..and the best you can probably get will be compensation for your out of pocket costs of reliance on the default (e.g. attorneys fees) You have a fight on your hands.. hire an attorney if you do not already have one.

You would need to move to reopen the decision based upon the newly discovered evidence. Since it has been three years you would need to show the court that your delay in bringing the action after three years is reasonable. Under the facts you have presented, you should have a good chance of reopening the decree.

I believe you are asking whether the attorney you hired for a divorce may hire you as an employee before the divorce is final.  This is an ethical question, not a legal question.  I do not believe there is a conflict of interest for an attorney to represent an employee, nor do I believe it is a conflict of interest for an attorney to hire a client as an employee.  Stu Shafer
