Who gets to stay in the house until the divorce is over?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
If neither party can afford it you have answered your own question, the marital home will have to be sold and whatever equity remains will be split between the parties. In the meantime, and during the pendency of the divorce, both parties have equal right to live in and use the marital residence for their lodging, unless there are other issues of spousal abuse or harm to each other or the children.

If I was awarded the house in our divorce, can my ex force me to sell?

If the house was awarded to you, you will not have to sell the house unless it was also decided that you were required to refinance the home to remove your husband from the loan within a certain time. It is possible that you can show efforts to do this and get an extension.
