How do I obtain a special warranty deed to release me from a mortgage, without refinancing the home.

Bradley Roger Gammell
Answered by attorney Bradley Roger Gammell (Unclaimed Profile)
Divorce lawyer at Gammell & Associates
A deed will not absolve you of responsibility for payment of the mortgage.   The mortgage is a matter of contract between the lender and (presumably) you and your ex-wife.   A divorce decree cannot alter that contract because the lender was not a party to the divorce.  When you got divorced, your attorney should have prepared a deed to secure assumption (which, in effect would allow you to foreclose on the house if she doesn't make the mortgage payments).

What should we do in our situation to have an official marriage, again?

John Michael Frick
Answered by attorney John Michael Frick (Unclaimed Profile)
Divorce lawyer at Reid Dennis Frick, PC
You should do what your husband's lawyer recommended.  Because your husband was still married to his co-worker when you participated in your second "remarriage" ceremony, that "remarriage" was illegal, invalid, and ineffective.  So clean it up by annuling that invalid "remarriage," and then remarry him again if you still want to be married.

Can DES do a DNA test without my knowledge or consent?

Answered by attorney William R. Pelger
Divorce lawyer at Pelger Law
That's a complicated situation. You would have to file support enforcement proceedings against someone you have now remarried and share a home with? You really need to go to the Family Division, see a counselor and look at the file to learn what is actually going on. Or, hire a lawyer to do it for you. As far as the testing, the Family Division can do mouth swabs on a reputed father if paternity is an issue, but the story sounds suspicious to me. Normally, DNA testing is difficult to get retroactively, is generally done only by court order, and is usually initiated by one of the parties, not the Family Division.
