Just because he is an illegal immigrant does not mean that he has no parental rights. Generally, you cannot move the child to another state without consent from both parents, but a court may allow you to do it anyway if you make an application and can show that it is in the best interests of the child to move elsewhere.

I have the divorce papers but he wont sign them because i want full custody of my son who is 13.I also have to get my address changed on the papers.

You can file without him signing and ask for a default judgment.  If he doesn't answer the complaint, it can be scheduled for a hearing and if he doesn't show up, default will be enetered.
