Is my physically handicapped daughter entitled to alimony?

Answered by attorney Lori Nevias
Divorce lawyer at Lori Nevias, Attorney at Law
Your daughter is absolutely entiled to spousal maintenance (alimony) as part of the divorce- even if she were NOT handicapped. Given that she is handicapped, she might be entitled to more than the statutory amount.

In New York State what is the potential marital asset value of a spouse who has become a RN during the marriage and previously worked minimally.

The question isn't the value of the RN, but the enhanced earnings capacity it generates. To calculate one looks at what the individual was doing before becoming an RN, what the salary was, and compares it to the earnings as an RN. A professional evaluation is usually necessary if this is to be a litigated point.

No, you do not have to wait a year. You can file at any time. However, if children are involved you would be well advised to consult with a local divorce lawyer rather than trying to do it yourself.
