How do I claim my portion of my ex husbands retirement?

Answered by attorney Amber Yerkey James
Divorce lawyer at New Beginnings Family Law, PC
The term is QDRO. You will have to have a QDRO drafted and approved by the Court and then sent to the administrator of your Husband's retirement account. This is not something that you should handle on your own as these can be very complicated. What does your divorce order say about who is responsible for having this drafted?

What should I do to ensure that my ex-husband will pay me for the house?

Answered by attorney Anthony James Sturniolo (Unclaimed Profile)
Divorce lawyer at Sturniolo & Associates
You have a couple options to enforce the Permanent Orders. You can obtain a Judgment against him for that amount plus interest and garnish his bank accounts and wages. The second option is a contempt citation against him for non payment. You can request attorney fees on both options. Your question does not indicate if the 5 years has passed yet.

Is our marriage void if my wife was married at the time?

default-avatar
Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
Yes, if one party is still married to someone else the marriage is prohibited and therefore void. Strictly speaking it is only "voidable" because you probably need to get a judicial declaration of invalidity to protect yourself. If the purpose of you question is based on wanting to keep the current relationship intact as a marriage, you should simply go and get married again.
