There should be an Order that preserves all assets of the marriage. If not, there will be a paper trail of any withdrawal that can be addressed during the divorce process. You should hire an attorney to protect your rights and make sure all assets are divided.

Second question first. It will cost you something. First question second: You can file divorce papers. After you have made good faith efforts to find and serve him but cannot, you can file a request with the court to have him served by publication in the city of his last known residence. This will cost to publish in the newspaper in that town. You will undoubtedly need the assistance of an attorney or paralegal to guide you through this process. Good luck.
