You don't say how long you've been married, but Texas is a community property state, so any income you've earned during the marriage (including retirement and pension accounts) are subject to division. I strongly recommend that you contact a divorce attorney to make sure your rights are protected.

Neither party will get what they want. The community property estate will be split in a fair and equitable manner. The fact that it is a newly purchased home, it is unlikely that you have enough equity in the home to make it worthwhile fight. You may have to buy her out of any equity to keep the home. If she can not pay, it is unlikely a court would award her the home. Go and consult with a local divorce/family law attorney if you want a better assessment of your case. Good luck.

You can send the divorce paperwork to your husband's last known address. If that doesn't work, you will need to use local directories (White Pages, Spokeo, etc.) to attempt to find his new address. If that doesn't work, you may ask the court where you filed the divorce paper work for permission to have him served by publication in the news paper. Most courts will allow you to do this if you can show the steps you took to find your husband before making this request.
