What exactly does "just that" mean? did the two of you file married filling joint tax returns during the relationship. If you were divorced from her the first time, the second date of marriage is the proper date for this divorce action. If your research determines you were not legally married the second time, you can petition the court for a dismissal of the action. You need to meet in person with a family law attorney who can help you unravel this.

If you have not had a paternity test ordered by the court, you will be liable for child support. Ask the court to order a paternity test and if you are not the father, you should be able to get the court to remove the child from the proceeding.

If you are contemplating divorce, I would strongly encourage you to seek legal counsel. Property acquired during the marriage is considered marital property for purposes of dividing property in a divorce. Any retirement assets acquired during the marriage are subject to division in a divorce as marital property.
