Does my wife have any rights to monetary gifts given to me prior to us getting divorced?

Answered by attorney Michael Gene Dehaven (Unclaimed Profile)
Divorce lawyer at Law Office of Michael G. DeHaven, P.A.
In Maryland, all "marital property" must be identified and subject to equitable distribution by a court considering a complaint for divorce. Marital property means that property acquired by 1 or both parties during marriage. However, any property acquired before the marriage, acquired by inheritance or gift from a third party, excluded by a valid agreement or directly traceable to any of these sources is not marital property.

Can I get put out my house because I committed adultery even if I owned the house with her?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
California is a no fault divorce state so the commission of adultery is irrelevant in retaining possession of your home or any other asset. Generally you can only be excluded from the family home in cases of domestic violence - physical or verbal.

What should be my next step if my ex failed to execute court ordered agreement?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
Divorce lawyer at Catchick Law, P.C.
I would need to review the actual language used in your Judgment of Divorce to give you a definitive answer - hopefully the Judgment requires her to remove your name or the house gets sold. If the Judgment is silent on the issue, then you will need to file a Motion requesting the Judge to enter a post-Judgment Order requiring your ex to remove your name within a certain time period (say, 30 - 90 days), with the house to be sold if she cannot remove your name.
