Notorized Divorce Agreement Not Filed

Morghan Leia Richardson
Answered by attorney Morghan Leia Richardson (Unclaimed Profile)
Divorce lawyer at Richardson Legal PLLC
It sounds like you and he signed a separation agreement and if that was properly signed and executed before a notary, then it is a legally binding contract, regardless of whether it was filed. There could be other issues that might lead to a separation agreement being found invalid, but you would have to challenge the agreement. Regardless, issues involving custody or visitation are always subject to modification. Really, all of these issues are extremely complicated and you are better served lining up some attorneys to consult with, rather than trying to piece it together on an online Q&A forum. Good luck!

If your husband is the spouse with the money he would likely be required to pay for your lawyer. What you are entitled to can't be determined without a full discusison of what assets there are as well as when and how they were acquired.

Did you sign a settlement agreement agreeing to sell it? If so, you have to follow the agreement. If there is no agreement you can wait until the judge orders it.
