Who will get the wedding ring during a divorce?

default-avatar
Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
Generally rings are considered personal items (like clothes, shoes, purses, other jewelry), as such they usually stay with the person who uses/wears them. Also, a wedding ring, an anniversary ring, a ring given as a gift were meant to be given to that person, they aren't marital property, they are sole property (gifts). However, if there is a very large value to certain jewelry, your friend may be able to argue that it wasn't a gift and it is community property, and therefore there should be an offset with other property, so that they each end up with equal amounts of community assets and debts.

Yes you can file for divorce. If you qualify the court will waive the fees and costs. If you cannot afford an attorney, speak with legal aid.

Do I need to file for divorce to get alimony?

default-avatar
Answered by attorney James T Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
You will probably not get alimony for a 3 month marriage unless you significantly changed your life to marry (e.g. quit a good job to move to be with him).
