If I leave my home can my husband say I abanded him and the home and get it in court?

  Your husband can say you "abandoned" him, but there is no "abandonment" under Florida law.  If the home was purchased during the marriage (or deeded to you during the marriage) then the home is a marital asset subject to being divided during a divorce.  (known as "equitable distribution")     However, with that said, you might have some liability for a portion of mortgage payments and other expenses attendant to maintain this marital assets while you are out of the house.  Still, it is a better alternative then subjecting yourself to potential violence or being accused of it. How do you get your divorce recognized in the US if you were married in the US but it was filed overseas?

  You don't say where the two of you last lived as a married couple.  Under Florida law if that location was Florida the proper place to file is Florida.    However, if the country where the divorce was filed does not have such a requirement and you have no objection, then presumably that country could enter a divorce decree.  A foreign divorce will be recognized in Florida.  However you do not say what you need it for.  If necessary you can go through a court process to domesticate the foreign judgment.  It is a two step process that transcends the scope of an answer here but is covered under Florida statutes. If either of you want a divorce at any time in the future, you don't need the other's consent or agreement to do so, and a post-nuptial agreement doesn't quite address that issue. Post-nuptial agreements generally address issues like spousal support/alimony, equitable distribution of assets and debts, separate property and joint property, etc. You may also want to consider the propriety of bringing a child into this dynamic. Consult with an attorney and discuss the specifics of your situation and your options.
