How can I get divorce if my husband is in prison?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
The same way you do when he isn't in prison. You file for divorce and have him served. It will be easier to have him served in prison because they know where he is.

What benefits can I be entitled to if I divorce this man after April 2013?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
You are entitled to one-half of all assets acquired during the "legal" marriage unless an asset was acquired by gift or inheritance. You can also file an action in civil court to try to trace recovery of any money you contributed to the "non - legal" marriage. You will probably need a lawyer for this.

Can I ask for child support at a domestic violence court date?

Answered by attorney Richard David Peacock (Unclaimed Profile)
Divorce lawyer at Peacock Law Group of the Lowcountry, LLC
In SC, if the Domestic Violence Court date is in Magistrate's Court or General Sessions, No. Family Court would be the appropriate Court with the jurisdiction to grant an award of child support. It would be wise to consult with a local family law attorney regarding this matter as soon as possible.
