In WI, from the date of service you cannot be divorced before 120 days has past so the earliest you could have a court date is January 12th if the other side was served September 12 but very few divorces get done in that time frame.

If he is properly served and does not disagree with your requests in the petition and does not respond you can request entry of default. If he responds then you both will either need to agree in the terms and move forward with an uncontested dissolution or go to court and dispute the terms.

You should have a contract, called a retainer agreement, that outlines what the attorney was supposed to do for you. Whether you do or don't, under the circumstances you should probably fire your attorney and demand a 100% refund of your retainer fee within a reasonable time (3 days). If you don't get your money back, file a formal complaint with your State Bar. While that is pending, get a new attorney to proceed with your divorce.
