Been separated 8 months can she take newly purchased items such as camper and boat?

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
In Texas, all property obtained during the marriage is presumed to be community property. As community property, it is subject to a just and right division. It is likely that a court would award you the camper and boat; however, all the property would be considered and divided in the divorce, including all the property in your wife's possession. Also, after the divorce is filed, you could negotiate the property division without having the court decide. If you can't come to an agreement, the court will make the decisions.

Can my ex have our judgment modified to prevent me from having guest?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
Probably not, but it kind of depends on the situation. If your guest is someone new every night, then maybe yes, because your child could be in danger. If the guest is a long term boyfriend, then less likely.

If I got married in Texas but I currently reside in New Mexico, where do I get a divorce?

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
Most states require that you live in the state and county for a certain amount of time before you file for divorce. You have to check the laws in the state where you live.
