Will the money given to me by my mom a year ago be included in her divorce?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
This is a common situation, that someone hears something from someone else and then has to ask an attorney if what they heard was correct. Each case is different and each case demands the attention of a competent attorney. What is acceptable in one case could be a hotbed of contention in another. Only the father can make an issue of this circumstance, and probably will not. It may not even become an issue. Most issued are resolved through hiring competent counsel or mediation.

If I leave marital home, will I still be entitled to spousal support?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
Spousal support does not depend on whether you are in the home, it depends on the length of the marriage and your ability to get a job and support yourself. There may be some factors from the marriage, but those are the main factors. You need to talk with a local attorney to figure out the likeliehood of getting spousal support.

Will a judge agree with us if my husband and I both agree that a past significant other cannot be around our child?

Answered by attorney Ronald Leon Bornstein (Unclaimed Profile)

Generally, if both parties are in agreement and the third party has no legal connection nor rights with respect to the child, then putting appropriate language in your agreement would generally be enforceable by the court pursuant to contract law. Consult with an attorney to discuss the specifics of your situation and your options.
