Will my wife be entitled to any of my retirement since we’ve not already lived for 4 years?

Answered by attorney Jon Laurence Rathjen (Unclaimed Profile)
Divorce lawyer at Law Office of Jon Rathjen
While your wife is entitled to half of any private retirement benefits you earned during the marriage from date of marriage to date of separation; thus the last 4 years would not count), social security is different. The only thing she is entitled to is the option, if married to you for more than 10 years, to take the greater of her own benefits or an amount equal to half of yours; neither option would affect your own benefits, which would stay the same. Spousal support is a complicated issue involving dozens of different factors, but the primary one is your respective incomes and needs.

What is the law against if my us husband wants to divorce me but i dont?

Answered by attorney Paul J. Wallin
Divorce lawyer at Wallin & Klarich, A Law Corporation
California is a "no fault" divorce state. This means either spouse can decide to divorce the other spouse without any reason at all. The other spouse cannot stop the divorce. In addition you cannot force your husband to "get you" citizenship in the US. As to money, when you divorce the court will decide if your spouse will pay you spousal support and will otherwise divide the community property assets.

Is there a way I can get the house or a big part of the profit from selling it?

One point may be the repayment of the loan back to your parents before there is any distribution of proceeds to the parties. Also proof of further loans by parents may deplete the equity further to repay them back. You will need solid proof of those loans.
