Is it true that in my divorce decree it states I’m entitled to half of my husband’s retirement if I do not remarry?

Answered by attorney Eric Allen Maskell (Unclaimed Profile)
Divorce lawyer at Law Office of Eric A. Maskell
If the original divorce decree stated that you were entitled to half of the retirement unless you remarried. And you remarried for a period of 2 1/2 years then it would seem under basic contract law that you are no longer entitled to half the retirement.

Does wife have any legal right to the car that I bought while we were separated?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
Yes, any property your purchased while legally married (even if separated) is community property and therefore jointly owned by you and your wife. The exception to this rule is if you executed a prenuptial or post marital agreement wherein you decided that what you buy belongs exclusively to you and what she buys is exclusively her separate property. Contact a family lawyer in your area to start the divorce process so there is no confusion about the division of assets in your marriage.

When resubmitting a rejected judgment, do I file it as an amended judgment, or an original one?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
Your question is too vague to give you an answer. If the judge said to submit a revised judgment, then you need to figure out what the problems were with the first one, draft a better order and send it to the court for entry.
