In some states this would be called abandonment. California is a no-fault divorce state, which means you do not need a reason, nor do you have to prove any facts, in order to qualify for a divorce. It is wise to avoid conflict, especially if children are involved. I am sorry you are going through this. The divorce judgement should control what happens to the house and other issues. If your ex refuses to sign the paperwork, the judgement can be used instead of his signature. Otherwise, you can get a court order requiring him to sign. The QDRO should be prepared by the party specified in the judgment.
