You did not mention how long you were married. If it is less than 5 years and you have no children you can file for a Summary Dissolution. If you have been married longer than 5 years or don't meet all the requirements, you can file an uncontested divorce. In my experience, your only options are to file for divorce on the fault ground while still living together in hopes the Court will take jurisdiction and grant temporary relief which is going to include ordering one of you to move out or you can file for an Order of Protection if truly you and/or the child are in danger.
