If you and your husband cannot agree it will be up to the judge to decide based on all the facts and circumstances. Generally, in Colorado the costs of sale (realtor fees, etc) are only deductible in computing the division of sale proceeds when there is actually a sale.

Should I seek out an attorney to represent me for an Uncontested Divorce?

It is always best to have an attorney prepare and file the paperwork for you. A lawyer can mediate the divorce between you and make sure you understand the ramifications of the language in your agreement. I can't tell you the number of clients coming to me after they have done the divorce themselves and then something is wrong with the paperwork. It costs less to get it right the first time.

In SC, there are several factors the Cort would weigh in determining which person would have custody and which person could have ownership and/or use of the marital home. You should really consult witha local attorney in regards to this matter.
