You should include it. The geographic restriction is meant to keep the father and the children in contact, but if he moves out he does not get that benefit. The paragraph that you speak of is there for a reason. I would advice that you consult a local divorce attorney if you have any doubts. Good luck.

Both you and your wife have equal rights to allow visitors in the house. While you may certainly express your disagreement, you will not be able to keep her from having her family in the home. However, you said you have an open divorce case so the judge could order that one of you have exclusive use of the home. If you get exclusive use of the home during the pendency of the divorce, this issue would not be a problem because your wife would not be living in the home.

If the house was awarded to your ex-wife in the divorce decree, then she has the right to sell it.  You need to check the divorce decree itself as well as look at the real property records at your county clerk's office.  When you inherit real property it becomes your separate property.  In a divorce a court may only divide community property.  You may need a lawyer's help to file a Bill of Review to attempt  to overturn the award of your separate property home to your ex-wife in the divorce.  The fact that you say you "signed off on" the divorce may be a problem, however, if the decree provides that the house was awarded to your ex-wife.  Do not wait any longer to resolve the title and ownership issues with this real property.
