I have a question about marital debt in a divorce.

Unfortunately, in general, just as any property or increase in value of property accrued during the marriage is marital property subject to division, so is debt.  There may be situations or factors that change your obligation on the debt, and certainly a savvy attorney can help you find any loopholes.   With $88,000 at stake, I definitely suggest you consult with an attorney.  - Kelly L. The courts expect you to make a good faith effort to located the spouse and serve them (I hire a private investigator to do a search, which is not expensive) and if you still cannot find them, you then file a motion to be allowed to serve the party by publication. I often take cases like this on a flat rate basis. I also offer a free initial consultation if you would like to discuss this further.
