Your dad can file for divorce. The guardian does not have to sign anything. She simply has to be served with the divorce papers and move forward from there. Warn your dad, however, that he might be paying spousal support to the guardian for the wife's care for quite a while. you can file an action (either for divorce or for support) to compel support; however, the easiest way to do it is to apply for State services. If you get services, the State will take him to court to help support your child.

If he fails to appear, he could be held in contempt of court and jailed. He cannot get the subpoena reversed. But he can call the attorney's office and tell them that he has no relevant knowledge about the case.
